You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 to place an Order. By placing an Order, You represent that You meet this requirement and that any information You provide, including for invoicing and GST purposes, is accurate.
AirOxi aeration tubes, diffusers and blower systems may be purchased both by aquaculture/fish-farm operators, water treatment contractors and similar business or institutional buyers, and by individual pond or backyard-aquaculture owners purchasing for personal, non-commercial use. Regardless of which category You fall into, the Product remains a technical, engineered product that must be sized and installed by an Authorised Installer in accordance with Clause 6 below; it is not designed for installation by an untrained individual, and the Product Warranty & Safety Policy will not be honoured if that requirement is not met.
Where You purchase as an individual for personal, non-commercial use, You are a “consumer” within the meaning of the Consumer Protection Act, 2019, and You have the full benefit of the rights conferred on consumers under that Act and the rules made thereunder; nothing in these Terms is intended to override a mandatory consumer protection right.
4. About the Products and the Website
The Website is an online store operated by Us for the sale of the AirOxi aeration tubes, diffusers, blower-driven aeration systems and related accessories used in aquaculture, fish/shrimp farming, ponds and water/wastewater aeration, sold under the AirOxi brand. Product specifications — including air/oxygen delivery rates, recommended blower size, pipe/diffuser dimensions and tested performance data — are described on the relevant product pages and accompanying technical literature, which form part of the description of the Products for the purposes of Section 14 read with Section 2(34) of the Consumer Protection Act, 2019.
Aeration performance depends on correct sizing of the blower and diffuser network to the specific pond/tank volume, stocking density, depth and water quality conditions at Your site, which can vary widely. You are responsible for providing Us or Your Authorised Installer with accurate site information for sizing recommendations to be valid. We reserve the right, at Our sole discretion, to refuse to process or to cancel any Order, including where We reasonably suspect fraud or where pricing or stock information was erroneous.
5. Account Registration
Certain Services require You to register for an account using a valid email address, mobile number and, where applicable, GST details. You are responsible for maintaining the confidentiality of Your login credentials and for all activity on Your account. You must notify Us immediately at the email address in Clause 20(g) below if You become aware of any unauthorised use of Your account.
Providing false, inaccurate or misleading information, or using the Website to further fraud or any unlawful activity, is grounds for immediate suspension or termination of Your account and any pending Orders, without prejudice to Our other rights.
6. INSTALLATION, COMMISSIONING AND USE — MANDATORY ENGAGEMENT OF A TRAINED OR CERTIFIED INSTALLER. AirOxi aeration systems combine mains-powered blowers with submerged or near-water piping and diffusers, and correct sizing, electrical safety and pipe-laying are essential both to performance and to safety. You acknowledge and agree that: (a) the Products must be sized, installed, commissioned and put into use only by an Authorised Installer, in accordance with the latest version of Our installation manual, sizing guidance and electrical safety guidance published on Our website and official social media pages from time to time, including appropriate earthing/RCD protection for blower units operating near water; You and Your Authorised Installer are responsible for checking and following the latest published version before commencing installation; (b) You are solely responsible for engaging and paying for such an Authorised Installer, and for ensuring that the installation is carried out, supervised and documented (including photographic records and an installation completion checklist) in accordance with Our installation guidelines; (c) any claim relating to inadequate aeration/oxygen delivery, blower failure, tube/diffuser blockage or rupture, electrical fault, or fish/stock loss, traceable wholly or partly to installation, sizing, or electrical work that was not carried out by an Authorised Installer, or that deviated from Our guidelines, shall not be entertained by Us and shall not be covered under the Product Warranty & Safety Policy; and (d) where the Product is supplied to a contractor or dealer for onward installation at a third-party farm/site, You shall ensure that the end-user/site owner is made aware of this installation requirement and shall retain proof of compliance to be produced to Us in the event of a warranty claim. Full installation conditions and consequences are set out in the Product Warranty & Safety Policy, which You should read before placing an Order.
7. Product Safety — Summary
AirOxi blowers are mains-powered electrical equipment installed close to water. Correct electrical protection (RCD/earth-leakage device, proper earthing) and installation by a qualified electrician/Authorised Installer are essential to safety and are a condition of cover under the Product Warranty & Safety Policy. The full safety disclaimer, including electrical-safety and PPE guidance, is set out in that Policy and forms part of these Terms by reference.
8. Intellectual Property
The AirOxi name and mark, all associated logos, the Website, its content, product literature, drawings, photographs and software, and any intellectual property relating to the design and construction of AirOxi aeration products, are owned by or licensed to Periti Industries Pvt. Ltd. (collectively, “Owner IP”). You may view, download and print Website content solely for Your own evaluation or installation reference in connection with a genuine purchase, and not for any commercial redistribution, reverse engineering or registration of confusingly similar marks or domain names.
Nothing in these Terms transfers any right, title or interest in the Owner IP to You. Any unauthorised use of the Owner IP automatically terminates the limited permission granted under this Clause.

We may, but are not obliged to, monitor content submitted to the Website (such as reviews or inquiry forms) and may remove anything We reasonably consider unlawful, offensive or in breach of these Terms.
10. Accuracy of Product Information
We take reasonable care to ensure that Product descriptions, technical specifications, performance data and images on the Website are accurate and current. Minor variations between photographs and the Product actually supplied (such as packaging updates) may occur and do not constitute a defect. Where We become aware of an error in pricing or specification before an Order is dispatched, We will notify You and give You the option to confirm the Order on corrected terms or cancel it for a full refund in accordance with the Selling, Shipping & Returns Policy.
11. Other Policies Forming Part of this Agreement

13. Limitation of Liability
Subject to Clause 6 (Installation) above and the Product Warranty & Safety Policy, and except in respect of liability that cannot lawfully be limited or excluded (including liability for death or personal injury caused by Our negligence, or liability arising from a defective product under the Consumer Protection Act, 2019), Our aggregate liability to You arising out of or in connection with these Terms, the sale of Products, or use of the Website, whether in contract, tort (including negligence) or otherwise, shall not exceed the price paid by You for the Products giving rise to the claim. We shall not be liable for any indirect, incidental or consequential loss, including loss of stock/livestock, loss of profit, loss of production cycle, or cost of alternative aeration arrangements, arising from Your use of the Website or the Products.
14. Indemnification
You agree to indemnify and hold Us harmless against claims, damages and reasonable legal costs arising from Your breach of these Terms, Your misuse of the Website, or installation/use of the Products otherwise than in accordance with Clause 6 and Our installation guidance.

19. Governing Law, Jurisdiction and Dispute Resolution
